Welcome to Msomi AI. By accessing or using our WhatsApp-based tutoring service, you agree to be bound by these Terms of Service. Please read them carefully.
1. Service Description
Msomi AI provides AI-powered tutoring services for Grade 9 students in Kenya through WhatsApp. Our service:
- Delivers curriculum-aligned answers based on KICD (Kenya Institute of Curriculum Development) materials
- Covers Mathematics, Integrated Science, and other Grade 9 subjects
- Operates 24/7 via WhatsApp messaging
- Offers both free and paid subscription tiers
2. Eligibility and Account Requirements
Age Requirement: Our service is designed for students aged 13 and above. Students under 18 require parental or guardian consent to use the service.
Account Registration:
- You must provide accurate WhatsApp contact information
- Parents/guardians are responsible for payment and account management
- Each WhatsApp number is limited to one account
- You are responsible for maintaining the confidentiality of your account
3. Acceptable Use Policy
You agree to use Msomi AI solely for educational purposes. Prohibited activities include:
- Using the service for exam cheating or academic dishonesty
- Sharing subscription access with others
- Attempting to reverse-engineer or copy our AI system
- Submitting inappropriate, offensive, or non-educational content
- Harassing or abusing our service or support staff
- Using the service for commercial purposes without authorization
4. Subscription and Pricing
Free Tier: Limited to 5 questions per day across all subjects.
Paid Subscriptions:
- Weekly Pass: KES 50 per week (unlimited questions)
- Monthly Pass: KES 150 per month (unlimited questions)
Payment Terms:
- All payments are processed via M-Pesa STK Push or Paystack
- Subscriptions auto-renew unless cancelled before the renewal date
- Prices are subject to change with 30 days notice
- All fees are non-refundable except as required by law
5. Cancellation and Refunds
You may cancel your subscription at any time:
- Cancellation takes effect at the end of the current billing period
- You retain access to paid features until the subscription expires
- No refunds are provided for partial billing periods
- Refunds may be issued in cases of technical errors or billing mistakes
6. Service Limitations and Disclaimers
Educational Support, Not Replacement: Msomi AI is designed to supplement, not replace, traditional education. Students should:
- Attend regular classes and follow their school curriculum
- Use Msomi AI as a study aid and homework helper
- Consult teachers for official academic guidance
Accuracy: While we strive for accuracy, Msomi AI:
- May occasionally provide incorrect or incomplete information
- Should not be the sole source for exam preparation
- Bases responses on KICD curriculum but may require updates
Service Availability:
- We aim for 99% uptime but cannot guarantee uninterrupted service
- Maintenance windows may temporarily affect availability
- WhatsApp outages or network issues may impact service delivery
7. Intellectual Property
All content provided by Msomi AI, including:
- Curriculum materials and explanations
- AI-generated responses and tutoring content
- Website design, branding, and logos
- Software and technology
Remain the property of Msomi AI or our licensors. Users may not reproduce, distribute, or commercialize our content without written permission.
8. User Content and Privacy
By submitting questions:
- You grant us the right to process and respond to your queries
- You acknowledge that questions may be used (anonymized) to improve our service
- Your data is protected according to our Privacy Policy
9. Limitation of Liability
To the maximum extent permitted by Kenyan law:
- Msomi AI is provided "as is" without warranties of any kind
- We are not liable for academic outcomes, exam results, or educational decisions
- Our total liability is limited to the amount you paid for the service in the past 12 months
- We are not liable for indirect, incidental, or consequential damages
10. Termination
We reserve the right to suspend or terminate access to our service if you:
- Violate these Terms of Service
- Engage in fraudulent or abusive behavior
- Fail to pay subscription fees
- Use the service in ways that harm our operations or other users
11. Changes to Terms
We may update these Terms of Service from time to time. We will notify users of material changes via WhatsApp. Continued use after changes constitutes acceptance of the updated terms.
12. Governing Law and Dispute Resolution
These Terms are governed by the laws of Kenya. Any disputes shall be resolved through:
- First, good-faith negotiation between the parties
- If unresolved, mediation under Kenyan arbitration rules
- As a last resort, litigation in Kenyan courts
